COMMERCIAL LICENSE AGREEMENT

THIS IS A LEGAL AGREEMENT BETWEEN YOU ("User") AND PATTERNOUS.COM ("Patternous"). THIS AGREEMENT APPLIES TO LICENSES ISSUED VIA THE WORLD WIDE WEB AND IS APPLICABLE TO ALL MATERIAL DOWNLOADED FROM THE PATTERNOUS.COM WEB SITE. BY DOWNLOADING MATERIAL FROM THE PATTERNOUS.COM WEB SITE, USER AGREES TO ALL THE TERMS OF THIS AGREEMENT.


I. DEFINITIONS

  1. "Licensed Material" means any digital image, raster graphic, vector graphic, template, font, computer generated, optically, electronically, digitally or by any other means including copies, prints and digital files of the material.
  2. "User" means an individual or entity or the Organization on whose behalf you are undertaking the License.
  3. Royalty-free (RF) license for personal and commercial use.

II. GRANT OF RIGHTS

  1. The Licensed Material is not being sold; It is being provided to the User under the terms of this agreement, which allows for use of Licensed Material but does not transfer ownership. Ownership remains with Patternous.com;
  2. User may include the Licensed Material in a website template intended to selling on the Marketplace;
  3. User may use the Licensed Materials for any commercial client's website or app.
  4. This agreement does allow for the use of Licensed Material in any Open Source project or application;
  5. User has the non-exclusive, non-transferable, non-sublicensable right to use the Licensed Material an unlimited number of times in any and all media for the personal and commercial purposes.
  6. User may alter, crop, manipulate and create derivative works of the Licensed Material for the personal and commercial use;
  7. User's rights to the Licensed Material are worldwide;

III. RESTRICTION

USER MAY NOT :

  1. Copy, distribute, relicense or sell the Licensed Materials;
  2. Transfer the Licensed Materials to another person or "mirror" the Licensed Materials on any other server.
  3. Make the Licensed Material available in any medium or manner intended to allow or invite a third party to download, extract or access the Licensed Material as a standalone file;
  4. Use any Licensed Material to promote illegal activity such as copyright infringement, racism, hate, mail fraud, spam, or other advice not permitted under applicable law.

IV. INTELLECTUAL PROPERTY OWNERSHIP

No ownership or copyright in any Licensed Material shall pass to User by the issuance of the license contained in this Commercial License Agreement. Except as expressly stated in this Agreement, Patternous grants User no right or license, express or implied, to the Licensed Material.
PATTERNOUS reserves the copyrights and ownership rights of all Licensed Material downloaded from this website.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF QUALITY, PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
